Every year divorce cases in india is increasing. Couples with economic independence doesn't think twice for filling divorce cases. Added to this IPC section 498a and domestic violence act when not used in right spirit also increases the divorce. Many cases where women centric law are misused breaks the family. I know one case where the wife receiving a letter from her husband to come and stay with her , she filed domestic violence and 498a. The husband who intended to continue marriage now decides to move out of the marriage. women doesn't see the cons of this laws when misused. The ego fight of many couples has created fatherless society. We are moving to era where we will be saying "your son and my son are playing with our son"

When it comes to child custody court doesn't have any norms or rules. Father has to fight the cases to get some days of custody. The whole judiciary doesn't see the needs of child. Child eventhough the parents are seperated will not feel the pain if the child has access to both parents. Judiciary delays even criminal cases by just by giving dates , imagine what seriousness the judiciary will have in child custody cases. Father are helpless seeing the whole system. Father is equally important like a mother. Mother is needed only in the infant stage breast milk feeding stages. Later father has much important role to play for the growth of the child. Many child learn things from their father.

Judiciary should do the following to save the rights of every child grown in seperated family

  • 2 days per week custody for non custodial parents
  • 50% vacation custody
  • equal share of education and living expenses of child
  • Judiciary to give immediate visitation right to a child when a father/Non custodial parents files a petition in court.
  • Judiciary to make sure that proper visitation is given by the custodial parent to non custodial parent. Any contemp by the custodial parents in this regard to dealt seriously

Child rights should not be ditched by their parents ego.
